Land Adjudication and Registration: How Unregistered Land Becomes Titled

Not every parcel of land in Kenya has always had a registered title. In many rural areas, land was historically held under customary tenure, without formal documentation, until the adjudication process brought it into the country’s formal registration system.

What Adjudication Means

Land adjudication is the process by which rights to land in a designated area are ascertained, recorded, and eventually formalized into registered titles — typically converting customary or communal claims into individual freehold or other registered interests.

How It Generally Works

An adjudication committee, working with local communities, identifies and records existing land rights and boundaries in a designated adjudication area. Once this process is complete and disputes are resolved, the land is surveyed, and formal titles are issued and entered into the land register — moving the parcel from customary, unregistered status to a fully titled one.

Why This History Matters to Buyers

  • Older titles may trace back to adjudication rather than a straightforward subdivision, and their history is worth understanding when buying, particularly in more rural areas.
  • Adjudication-related disputes still surface. Boundary or ownership disputes originating from the original adjudication process occasionally resurface years later, which is part of why a thorough title verification process matters even for long-registered land.

Why This Matters for Kenya’s Land Market Broadly

Adjudication is part of why formal land ownership has become as widespread as it is today, particularly in agricultural areas like much of Nyeri and Laikipia counties, laying the groundwork for the modern, title-based land market buyers rely on now.

Bottom Line

Most buyers today deal with already-titled land, but understanding how that title system came to exist helps explain why thorough verification remains essential, regardless of how old or established a title appears.
